La base de datos privados -incluyendo los RUT- de quienes retiraron el 10% de su AFP que fue solicitada por el Ministerio de Hacienda, causando rechazo desde el Congreso y la ciudadanía, ya fue eliminada, de acuerdo a la misma cartera.
Cabe recordar que al conocerse su petición a la Superintendencia de Pensiones, el titular, Ignacio Briones, la defendió en repetidas ocasiones, arguyendo que el Gobierno utilizaría la información con “un fin netamente estadístico, y no es inmiscuirse en la vida personal”.
De hecho, tras confirmar que su cartera ya la había recibido, adelantó en Cooperativa que la base contaba con un “protocolo de las mejores prácticas internacionales, (que permite que) después de 15 días se elimina“.
Este plazo de caducidad fue ratificado en la respuesta del nuevo subsecretario de Hacienda, Alejandro Weber, a los oficios paralelos de los diputados Andrés Celis (RN) y Claudia Mix (Comunes), quienes consultaron a la cartera al respecto, consignó El Mercurio.
En rigor, el periodo de almacenamiento fue de 15 días hábiles a partir de la recepción de los datos, registrada el 26 de octubre; por lo tanto, “con fecha 16 de noviembre de 2020 se procedió a eliminar por completo los datos transferidos por la Supen”.
Para efectos de su destrucción, el oficio de respuesta explica que se utilizó la herramienta “shred”, incluida de forma estándar en el sistema operativo Linux, que sobreescribe los contenidos de los archivos repetidas veces -25 por defecto- con data aleatoria, previo a su eliminación desde las tablas de directorio, algo que “fue certificado notarialmente el mismo 16 de noviembre pasado”, de acuerdo a Weber.
Además de las acciones de Celis y Mix, al igual que de otros parlamentarios que oficiaron a la Contraloría General de la República y al Consejo para la Transparencia por la solicitud, alrededor de mil personas la denunciaron ante el ente contralor.
A pesar de que Hacienda insiste que la Ley 20.403 faculta a su cartera y a otras reparticiones a pedir estos antecedentes, en su momento el senador Francisco Huenchumilla (DC) advirtió que esta operación “es contraria a las disposiciones de la Constitución”, pues en 2018 se aprobó una reforma que eleva a rango constitucional el derecho a la protección de los datos privados.
